Terms of Service

These Terms of Service ("Terms") govern your use of the GrowSmart web application at getgrowsmart.com ("the App"), operated by Amanda Holt ("we," "our," "us") from Ontario, Canada. By using GrowSmart, you agree to these Terms. If you do not agree, please do not use the App.

1. What GrowSmart Is

GrowSmart is a garden planning tool that generates personalized planting schedules based on local frost dates and hardiness zone data. The App provides planting timelines, companion planting information, succession planting schedules, care logging, and garden layout planning.

GrowSmart is an informational planning tool. It is not a substitute for professional agricultural advice. Planting outcomes depend on many factors beyond frost dates, including soil conditions, microclimate, weather variability, pest pressure, and individual plant health. We do not guarantee any specific gardening results.

2. Eligibility

You must be at least 13 years of age to use GrowSmart. If you are under 18, you should use GrowSmart with the involvement of a parent or guardian. By using the App, you represent that you meet this age requirement.

3. Account and Subscription

3.1 Free Tier

GrowSmart offers a free tier that includes access to core planning features for up to 10 plants in the spring season. No account or payment information is required to use the free tier.

3.2 Pro Subscription

The Pro plan is available at $4.99 CAD per month or $39 CAD per year. Pro unlocks all 183 plants, 3-season planning (spring, summer, fall), and additional features as described on the App. Prices include applicable GST/HST.

Subscriptions are processed by LemonSqueezy, our payment provider. By subscribing, you also agree to LemonSqueezy's terms of service. LemonSqueezy handles all payment card processing — we never see or store your card details.

3.3 Billing and Renewal

Subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You can cancel at any time through your LemonSqueezy account portal. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.

3.4 Refunds

If you are unsatisfied with GrowSmart Pro, contact us at hello@getgrowsmart.com within 14 days of your initial purchase for a full refund. Refund requests after 14 days are handled on a case-by-case basis. Refunds for renewal charges are not guaranteed but will be considered if requested promptly.

4. Your Data

4.1 Local Storage (Phase 1)

Currently, all garden data — plant selections, care logs, garden layouts, and settings — is stored in your browser's localStorage on your device. We do not have access to this data, cannot recover it, and are not responsible for its loss. If you clear your browser data, switch devices, or use a different browser, your data will not be available.

4.2 Cloud Sync (Phase 2 — Planned)

We plan to introduce optional cloud sync in Summer 2026. Cloud sync will require account creation and will be opt-in. Details will be provided when this feature becomes available, and these Terms will be updated accordingly.

4.3 Data Ownership

Your garden data belongs to you. We will never lock you out of data you have entered into GrowSmart. The free tier provides full access to data you have created, even if you downgrade from Pro. Pro features (such as fall season planning) may become view-only on the free tier, but your data will remain accessible.

6. Intellectual Property

All content, design, code, data, plant descriptions, images, companion planting information, brand elements, and documentation within GrowSmart are owned by Amanda Holt or used under license. This includes the GrowSmart name, logo, tagline ("Learn. Grow. Succeed."), and visual brand identity.

You may not copy, reproduce, distribute, or create derivative works from any part of GrowSmart without prior written permission, except for personal, non-commercial use of your own garden plans (for example, printing your own layout for personal reference).

7. Data Accuracy and Disclaimer

We make every effort to provide accurate frost dates, hardiness zone data, planting schedules, and companion planting information. Our data sources include Environment Canada Climate Normals (1991–2020), Natural Resources Canada Plant Hardiness Zone Map (2024 update), NOAA Climate Normals (1991–2020), and the USDA Hardiness Zone Map (2023).

However, climate data represents historical averages and does not predict actual weather conditions in any given year. Frost dates can vary significantly from year to year. Companion planting relationships are based on published horticultural research, but results may vary based on growing conditions.

GrowSmart is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be error-free, uninterrupted, or that any specific gardening outcome will result from its use. You use GrowSmart at your own discretion.

8. Limitation of Liability

To the maximum extent permitted by law, Amanda Holt and GrowSmart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to crop loss, garden damage, data loss, or loss of profits.

Our total liability for any claim arising from your use of GrowSmart shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 CAD, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Canadian law.

9. Third-Party Services and Links

GrowSmart may contain links to third-party websites, affiliate partners, or seed suppliers. We are not responsible for the content, accuracy, privacy practices, or availability of these external sites. Inclusion of a link does not imply endorsement.

Affiliate links, when present, will be clearly identified. We may earn a commission on purchases made through affiliate links at no additional cost to you.

10. Modifications to the App and Terms

10.1 App Changes

We may add, modify, or remove features at any time. We will make reasonable efforts to communicate significant changes through in-app notifications or our newsletter. If a feature you rely on is removed, you may cancel your subscription.

10.2 Terms Changes

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. For significant changes, we will provide notice through in-app notification or email to subscribers. Your continued use of GrowSmart after changes are posted constitutes acceptance of the updated Terms.

11. Termination

You may stop using GrowSmart at any time. If you have a Pro subscription, cancel through your LemonSqueezy account portal to stop future billing.

We reserve the right to suspend or terminate access to GrowSmart if you violate these Terms. In the event of termination for cause, no refund will be provided for the current billing period.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of GrowSmart shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
