1. Overview
GrowSmart is operated by Amanda Holt from Ontario, Canada. We comply with Canada's Anti-Spam Legislation (CASL) and the United States CAN-SPAM Act in all commercial electronic messages we send.
This page explains how we collect consent, what messages we send, and how you can withdraw consent or unsubscribe at any time.
2. Canada's Anti-Spam Legislation (CASL)
2.1 Express Consent
We only send commercial electronic messages (CEMs) to individuals who have provided express consent. Express consent is collected through:
- The email signup form on our website, which requires an active checkbox confirming consent
- Clear disclosure of what messages you will receive (gardening guides, planting tips, and product updates)
- Identification of GrowSmart as the sender
We do not use pre-checked consent boxes. Consent is always a deliberate action by the subscriber.
2.2 Implied Consent
Under CASL, implied consent may exist if you have an existing business relationship with GrowSmart — for example, if you have purchased a Pro subscription within the past two years. We treat implied consent conservatively and convert it to express consent at the earliest opportunity.
2.3 Sender Identification
Every commercial message we send includes:
- The name "GrowSmart" as the sender
- Our mailing address: Foxboro, Ontario, Canada
- A valid contact email address
2.4 Unsubscribe Mechanism
Every commercial message includes a functional unsubscribe link that:
- Works for a minimum of 60 days after the message is sent
- Processes unsubscribe requests within 10 business days (CASL requirement)
- Requires no more than a single action to complete (no login, no surveys)
- Is clearly visible and not obscured by design elements
2.5 Record Keeping
We maintain records of:
- When and how consent was obtained
- The specific consent language presented to the subscriber
- Unsubscribe requests and their processing dates
3. United States CAN-SPAM Act
For subscribers in the United States, we additionally comply with the CAN-SPAM Act of 2003:
- No misleading headers: The "From," "To," and "Reply-To" fields accurately identify GrowSmart
- No deceptive subject lines: Subject lines reflect the actual content of the message
- Identified as advertising: Where required, messages are identified as promotional content
- Physical address included: Every message contains our valid physical postal address
- Opt-out honored: Unsubscribe requests are processed within 10 business days
- No opt-out fees or requirements: Unsubscribing is free and requires no conditions
4. What Messages We Send
When you subscribe, you may receive:
- Gardening guides: Frost date cheat sheets, companion planting charts, succession planting guides
- Seasonal planting reminders: Timely alerts based on your hardiness zone
- Product updates: New features, plant database additions, and app improvements
- Occasional promotions: Pro plan offers or partner recommendations (clearly labelled)
We do not sell, rent, or share your email address with third parties for their marketing purposes.
5. How to Withdraw Consent
You can withdraw consent at any time by:
- Clicking the unsubscribe link in any email
- Emailing us directly at hello@getgrowsmart.com with "Unsubscribe" in the subject line
Once you withdraw consent, we will stop sending commercial messages within 10 business days. Withdrawal of consent does not affect your ability to use the GrowSmart app.
6. Third-Party Email Services
We use third-party email service providers to deliver messages. These providers are contractually required to handle your data in compliance with CASL and applicable privacy laws. They do not use your information for their own marketing purposes.
